Notice is hereby given that the Town of Vivian will conduct a public hearing for the adoption of the following Ordinances bearing the titles:

 

1.    Ordinance No. 18-0201 –  An ordinance for the Code of Ordinance, Town of Vivian, Louisiana, to amend   SECTION 7-3 Trash fires restricted of ARTICLE I IN GENERAL of CHAPTER 7 of the Code of Ordinances of the Town of Vivian

TOWN COUNCIL MEETING

MONDAY, March 9, 2018 6:00 P.M.

CALL TO ORDER /VERIFY QUORUM - the regular called council meeting

was called to order at 6:02 p.m. with Mayor Pro Tem Judy Wilson presiding and the following council members present: Raymond Williams, Judy Wilson, Angela Channel Denise Alexander, and Mandi Burton, absent was: Mayor Mike VanSchoick.

INVOCATION –Raymond Williams led the prayer

PLEDGE OF ALLEGIANCE - North Caddo High School Color Guard let all present in the Pledge of Allegiance.

SCHOOL ANNOUNCEMENTS- North Caddo Girls’ Basketball is ranked #1 in state, district champs, Boy’s are state runner up.

CITIZENS COMMENTS- Jim Slagle made comments about the minutes being too long in the paper and it is costing the town more money and questioned some recent purchases and service from the town. Also, his concern for a new building being up to code.

FINANCIALS-  Were presented to Council at meeting.

MINUTES- Motion was made by Raymond Williams and seconded by Angela Channel to accept the minutes of February’s meeting.

Discussion- Prohibiting weapons in public building.

Council discussed possible Ordinance to prohibit firearms and dangerous weapons in public buildings. The topic was brought up By Raymond Williams, but the board did not feel this Ordinance could be enforced and would not pass in a vote. No further action was taken.

ANNOUNCEMENTS:

v Red Bud Schedule was read by Denise Alexander.

v Red Bud T-shirts for sell and tickets for the breakfast can be purchased at the Museum.

v March 24 @ 12pm, Colquitt Baptist Church is having a community feeding at the Kiwanis Community Center. If you can’t get out delivery arrangements are available.

CITIZENS COMMENTS – Bill Geaslin- New business in town, sky diving. He encourages everyone to come by. Also offers lessons. Jim Slagle made comments about his comments and the boards comments being placed in the minutes verbatim. Ronda Carter- Drainage problems possibly caused by the town. She asks that this problem be reviewed and fixed as soon a possible to begin structural repairs to her home.

 

KNCB- Robert DelGiorno presented Annie Cherry and Chris Bain with awards for " Man and Woman of the Year" as per KNCB. This year's award was determined by all the many things they have done for the children of our community. He plans for this to become an annual award.

PUBLIC COMMENTS: Jim Slagle- He voiced his concerns about proposed Ord. No. 18-0101, amendment to Fireworks ordinance already in place following state laws. He also asked about getting more local sellers and whether the fireworks stand pays sales tax. Judy responded that the current fireworks operator is local. Hearing closed.

TOWN OF VIVIAN

 

ORDINANCE # __18-0101_ of 2018

 

                An ordinance of the Code of Ordinances, Town of Vivian, Louisiana, to amend and supplement CHAPTER 11 MISCELLANEOUS OFFENSES OF ARTICLE V OFFENSES AFFECTING THE PUBLIC, SECTION 11-143 FIREWORKS of the Code of Ordinance of the Town of Vivian as follows:

 

                BE IT THEREFORE ORDAINED by the Board of Alderman of the Town of Vivian in due, regular and legal session convened, that the Code of Ordinances, Town of Vivian, Louisiana, that SECTION 11-143 FIREWORKS to read as follows:

 

Sec. 11-143. - Fireworks.

 

(a) The term "pyrotechnics," whenever used in this section shall be held to mean any sparkler, squib, rocket, firecracker, roman candle, signal lights, fireworks, or other devices or composition used to obtain visible or audible pyrotechnic display.

 

 (b) It shall be unlawful for any person to have, keep, store, use, manufacture, offer to sell, handle or transport any pyrotechnics within the corporate limits of this town except as herein provided, it being the intention of this section to prohibit the sale of, distribution of, or discharge of pyrotechnics of any kind or description whatsoever within the corporate limits.

 

(c)  Nothing contained in this section shall be held to apply:

 

(1) To the possession or use of signaling devices for current daily consumption by railroads, trucks or vessels requiring them.

 

(2) To pyrotechnic display of fireworks in public parks or other open places where a permit for such display has been issued by the town.

 

(3) To the possession, sale or use of normal stacks of flashlight compositions by photographers or dealers in photographic supplies.

 

(4) To keeping, storing, using, selling, handling, transporting any pyrotechnics (fireworks) within the corporate limits during the following dates: June 25 through 10:00 PM July 5th and noon December 15th through 10:00 PM January 1 of each year.

 

                (a) On the dates set forth in subsection (4) of this section, it shall be unlawful for any person to discharge, ignite or explode fireworks within the town limits between the hours of 10:00 p.m. and 8:00 a.m.; provided, however, such activities shall not be unlawful on December 31 of each year between the hours of 10:00 p.m. and 1:00 a.m.

 

 

(5) To pyrotechnics (fireworks) discharged at the place of residence of the person or persons discharging same.

 

(6) To pyrotechnics (fireworks) stored and sold only at fixed places of business after obtaining a proper permit from the town to do so.

 

(d) Certain fireworks prohibited. It shall be unlawful for any person at any time to possess, sell or use any type of bottle rockets or sky rockets with sticks.

 

(e) Whoever violates the provisions of this section shall be punished as provided in section 1-13 of this Code.

 

 

                After public hearing was held on the above Ordinance, the title having been read and the Ordinance considered, on motion by Alderman _____________ seconded by Alderman _____________ to adopt the Ordinance, a record vote was taken, and the following result was:

Motion was made by Raymond Williams and died for a lack of a second. Town attorney Douglas Dominick responded that this was the Ordinance in place with the parish or City of Shreveport and he would look further into it.

v Unity Breakfast this past Saturday was a success.

v Questions about the audit from Denise. Also, was there an outside company hired to print W2's, which I responded yes and no. The software we currently use printed the W2's due to software issues. No employee of the town had the knowledge to print them and the software company could not provide training, nor the spaific paper needed to print. She requested a copy of the invoice. Denise also announced that she had copies of documentation from an ethics claim filed against her.

CALL TO ORDER /VERIFY QUORUM - the regular called council meeting

AMENDMENT TO THE AGENDA: Motion to amend the agenda to add the public hearing for Ord. No. 17-1201- Insurance Premium Tax Program offered by LMA, where LMA would collect and monitor collection of the premium collected from Insurance companies due to the Town of Vivian at no cost to the Town, that was advertised for today but left off the agenda due to clerical error. Motion was made by Raymond Williams and seconded by Judy Wilson.

Motion failed due to lack of unanimous vote.

 

CITIZENS COMMENTS – Jim Slagle made comments about his comments and the boards comments being placed in the minutes verbatim. He voiced his concerns about the delayed 2016/2017 audit and the competence of the town clerk.

 

FINANCIALS-  Were presented to Council at meeting. Councilwoman Denise Alexander had questions about the software programmer as well as the outsourced accounting firm hired. Denise questioned the Mayor about the audit and Councilwoman Angela Channel asked for an update on the functionality of the new software.

 

 

MINUTES- Motion was made by Raymond Williams to accept the minutes of December’s meeting but died for lack of second.

 

 

INTRODUCTION OF ORD. Public Hearing will be held at next meeting February 12, 2018.

 

FINAL CONDEMNATION FOR 316 Lowland – The board of aldermen will hold a condemnation hearing to determine why any and all buildings and/or structures should not be condemned on the following described property. Betty Washington spoke on behalf of the property owner. Councilwoman Judy Wilson asked where was the owner in which Betty replied that their mother is deceased and there were no legal papers filed to transfer ownership to Barron Carter, which no one has spoken to. Angela asked if anyone knew what Barron wanted to do with the property. Councilman Raymond Williams voiced his opinion stating that he did not feel the property could be repaired.

 

Motion made by __Raymond Williams__ to proceed with the final condemnation process. This motion was seconded by Judy Wilson.

Attorney Douglas Domonick responded with laws regarding mintues stating they only require general records of actions voted on.

CITIZENS COMMENTS -

Public comments were made by: Jim Slagle-  expressed his concerns about the Citizen at the a prior meeting about a citation for demolition, Financials, Airport Manager not being in last minutes, not noting that code enforcement officer was not at the last meeting in minutes, the fact the Doug hadn’t seen the resolutions before the last meeting not noted in minutes, taxes being taken earlier, rumors of only one employee taking payments at Town Hall, the posting of the agenda not signed and dated, information requested at prior meeting and requested Town Attorney, Doug, look into penalty for not providing information, offered the clerk’s time clocked in and out daily that he had a copy of, and question the mail he received as well as all the aldermen, as far as he knows, of a private conversation from a stolen phone that is under investigation.
